Subclass 188: Entrepreneur Stream

The Subclass 188 – Entrepreneur Stream is for startup entrepreneurs nominated by a State or Territory government agency to develop their concepts and continue their entrepreneurial activities in Australia.  

With this visa, you can:

  • Carry out entrepreneurial activity in Australia
  • Bring eligible members of your family with you
  • Apply for permanent Business Innovation & Investment (Permanent) visa (Subclass 888) in the Entrepreneur Stream if you meet the requirements.

Subclass 188 - Entrepreneur Stream Eligibility

To be eligible for a Subclass 188 - Entrepreneur Stream, you must: 

 You must be nominated by an Australian State or Territory government agency to be eligible to apply for the visa.

Once you have secured an invitation, you will receive an invitation from the Department to apply for the visa through Skill-Select.

You must be under 55 years of age to be eligible for this visa.

You will not receive an invitation unless the State or Territory government agency has determined your proposed entrepreneurial activity will be of exceptional economic benefit.

You must be undertaking or proposing to launch a complying entrepreneur activity in Australia. You must have a genuine intention to continue this activity.

A complying entrepreneur activity must relate to an innovative idea that will lead to:

  • the commercialisation of a product or service in Australia, or
  • the development of an enterprise or business in Australia

If you were invited to apply for this visa on or after 1 July 2021, you must be endorsed by your nominating State or Territory government agency to develop your entrepreneurial concepts.

If you were invited to apply for this visa before 1 July 2021, you must have one or more legally enforceable agreements to receive funding with a total of at least AUD200,000. 

You and your partner must have had no history of involvement in business or investment activities that are of a nature that is not generally acceptable in Australia.

You and family members aged 16 years and over who apply for the visa with you must meet the Department’s health and character requirements.

All applicants aged 18 or over at the time of application must either have at least functional English or you will be asked to pay the second instalment of the visa application charge. 

If you or any family members owe the Australian Government money, you or they must have paid it back or have an approved arrangement in place to pay it back.

You must sign an Australian Values Statement that confirms you will respect the Australian way of life and obey Australian laws

You might not be eligible for this visa if you have had a visa cancelled or refused while you were in Australia.

    Which are the approved entities for receiving your funding?

    The funding must be from one of the following entities:

    • Commonwealth Government agency
    • State or Territory government agency
    • Publicly funded research or innovation organisation
    • Higher education provider specified as a Table A or Table B provider under Part 2-1 of the Higher Education Support Act 2003
    • Investor registered as an Australian Venture Capital Limited Partnership or Early Stage Venture Capital Limited Partnership
    What happens if the State or Territory withdraws their nomination after the application process has begun?

     The department will not be able to grant the visa if the nomination is withdrawn by the state or territory.

    What activities does not come under complying entrepreneur activity ?

    The complying entrepreneur activities must not relate to any of the following categories:

    • residential real estate
    • labour hire
    • purchase of an existing enterprise or a franchise in Australia
    What should your business plan indicate?

    The business plan should note how your innovative idea will lead to:

    • the commercialisation of a product or service in Australia, or
    • the development of an enterprise or business in Australia
    How long can I stay in Australia with this visa?

    This is a provisional visa. You can stay in Australia for up to 5 years if you were invited to apply for this visa on or after 1 July 2021.

    If you applied after 1 July 2015 and were invited to apply for this visa before 1 July 2021, you can stay in Australia for up to 4 years and 3 months.

    If you applied before 1 July 2015, you could stay up to 4 years.

    Can I travel with this visa?

    You can travel outside Australia and return as many times as you want while the visa is valid.

    The time you spend outside Australia does not extend the visa.
