Subclass 188A: Business Innovation & Investment (Provisional) visa - Business Innovation Stream

The Subclass 188 – Business Innovation Stream is for people with business skills who wishes to operate a new or existing business in Australia for up to 5 years.

With this visa, you can:

  • bring members of your family unit with you
  • Apply for permanent Business Innovation & Investment (Permanent) visa (Subclass 888) in the Business Innovation Stream

Subclass 188 - Business Innovation Stream Eligibility

To be eligible for a Subclass 188 - Business Innovation Stream, you must: 

You must be under 55 years of age to be eligible for this visa.

If you are above 55 or older at the time of the invitation to apply for the visa, you will not receive an invitation unless if your business will be of exceptional economic benefit.

You must be nominated by an Australian State or Territory Government or agency to apply for the visa. 

All applicants aged 18 or over must either:

  • have at least functional English (overall IELTS score of 4.5 based on the 4 test components) or
  • pay the second instalment of the visa application charge. 

You must obtain a score of 65 points to be invited to apply for this visa.

You can get points for many reasons, including your: 

  • age
  • English language ability
  • qualifications
  • business experience
  • net personal and business assets
  • business turnover
  • innovation
  • special endorsement

You must have a successful business career and a genuine desire to continuously own and manage a business in Australia.

When you are invited to apply for this visa, you, your partner, or you and your partner combined must have total net business and personal assets of at least:

  • AUD1.25 million if you were invited to apply on or after 1 July 2021.

If you or any family members owe the Australian Government money, you or they must have paid it back or have an approved arrangement in place to pay it back.

Applicants aged 16 years old or over must meet the Department’s health and character requirements.

You/your partner must not have any history of involvement in business or investment activities that are not generally acceptable in Australia.

For 2 out of 4 fiscal years immediately before applying for the visa, you must have had an ownership stake in 1 or 2 businesses that had at least:

  • AUD750,000 turnover in each of those 2 years if you were invited to apply on or after 1 July 2021

 

Whether you have 1 or 2 businesses, you must own at least:

  • 51% of the total value of the business if the business has a turnover of less than AUD400,000 per year
  • 30% of the total value of the business if the business has a turnover of AUD400,000 or more per year, or
  • 10% of the total value of the business if the business is operated by a publicly listed company

    Do I need to buy a business or invest to apply for the visa?

    No, you do not have to buy a business in advance, or invest any money anywhere before applying for a business visa.

    What happens if the State or Territory withdraws their nomination after the application process has begun?

     The department will not be able to grant the visa if the nomination is withdrawn by the state or territory.

    How long can I stay in Australia with this visa?

    This is a provisional visa. You can stay in Australia for up to 5 years if you were invited to apply for this visa on or after 1 July 2021.

    If you applied after 1 July 2015 and were invited to apply for this visa before 1 July 2021, you can stay in Australia for up to 4 years and 3 months.

    If you applied before 1 July 2015, you could stay up to 4 years.

    Can I travel with this visa?

    You can travel outside Australia and return as many times as you want while the visa is valid.

    The time you spend outside Australia does not extend the visa.

    Can I apply for permanent residency with this visa?

    Holders of the Subclass 188 Business and Investment visa can continue living in Australia permanently by applying for a Subclass 888 – Business Innovation stream visa.
